Yahoo! News: Federal report reveals tax prep companies shared personal, financial data without consent

“It’s hard to trust that your privacy is being protected by companies like this,” said John Davisson, Director of Litigation & Senior Counsel at the Electronic Privacy Information Center (EPIC).

The report shows these companies shared more than just name, emails, and phone number. They also shared personal tax info like having dependents, adjusted gross income and refund amounts.

“Tax information, financial information is some of the most closely guarded personal data that we have,” said Davisson.

EPIC Statement on NDAA Senate Amendment 218 regarding privacy for Members of Congress and their families

Congress is currently considering passing a narrow and ineffective privacy law; they should take a more comprehensive approach as EPIC has previously recommended. Senate Amendment 218 offered by Senators Klobuchar and Cruz as a floor amendment to the Senate’s Fiscal Year 2024 National Defense Authorization Act (S. 2226), would in practice do very little to protect the privacy of personal information about members of Congress and their families. The bill as currently written would make almost all data brokers exempt from the rules that are ostensibly meant to limit data broker sales of protected personal information. Congress should not pass a privacy and data broker bill that fails to regulate data brokers or protect consumers. 

Amendment 218, similar to the Judicial Security and Privacy Act that Congress enacted last year, purports to prohibit data brokers from knowingly selling, licensing, trading, transferring, or purchasing the personal information of those covered by the bill (Members of Congress, their close relatives, and some Congressional staff). The ostensible goal is to limit access to addresses and other personal information that could pose a risk to these individuals. But the bill as written exempts any “consumer reporting agency subject to the Fair Credit Reporting Act” and any “financial institution subject to the Graham-Leach-Bliley Act.” But these are precisely the types of data brokers that buy and sell people’s personal information in ways that could put the subjects of this bill at risk. 

The entities subject to the FCRA include commercial websites like Spokeo that sell access to personally identifiable information, including contact data, marital status, age, occupation, economic health, and wealth information. And the GLBA applies to a wide range of entities that “offer financial products and services to individual” like loans and insurance. So Amendment 218 would, by exempting these entities, not actually accomplish the goal of protecting members of Congress and their families from data brokers and threats to their privacy or security. 

All Americans deserve privacy protections that actually work. That is why we urge the Senate to to reject Amendment 218 and instead work towards passing meaningful, comprehensive privacy protections for all Americans.

Data Minimization: Bolstering The FTC’s Health Data Privacy Authority

Among the categories of personal data collected seemingly without restriction in the United States, consumer health data is both particularly sensitive and particularly lucrative. In recent years, there has been a dramatic increase in telehealth, health and fitness apps, and other online health products, resulting in an enormous volume of health data collection and abuse that falls outside of the narrow protections of the Health Insurance Portability and Accountability Act (HIPAA). The Federal Trade Commission (FTC) works to fill this gap by using its broad Section 5 authority and by enforcing the Health Breach Notification Rule (HBNR). But as the FTC considers promulgating a new rule to govern the commercial processing of personal data, it has the opportunity take a more comprehensive approach to protecting consumer health data privacy and security.

EPIC has long urged the Commission to issue a data minimization rule using its Section 5 authority to regulate unfair and deceptive trade practices. An effective data minimization rule would establish that it is an unfair trade practice to collect, use, transfer, or retain personal data beyond what is reasonably necessary and proportionate to the primary purpose for which it was collected, consistent with consumer expectations and the context in which the data was collected. The previous blog posts in this series have elaborated on critical aspects of data minimization for the FTC’s forthcoming commercial surveillance and data security rule: centering reasonable consumer expectation, limiting the scope of permissible data uses, and the key role that data minimization can play in data security. While a data minimization-focused commercial surveillance rule would apply broadly to various types of consumer data, this blog post will focus on health data as a case study, illustrating how a data minimization rule would bring stability, predictability, and security to consumers about their health data.

Consumer Health Data Collection and Use

Consumer health data collection has skyrocketed in recent years. The broad availability and convenience of smartphones and internet access has enabled “Americans to turn to apps and other technologies to track diseases, diagnoses, treatment, medications, fitness, fertility, sleep, mental health, diet and other vital areas[.]” Our understanding of what constitutes health data has grown as data analysts and data brokers have demonstrated their ability to infer health-related insights from a widening range of data sources. For example, location data can become sensitive health data, like GPS data indicating that someone has visited a methadone or abortion clinic. Location data can also reveal healthcare activity and related behavior.

Unbeknownst to many consumers, most of this health data collection is not regulated by HIPAA. Most of the apps, platforms and companies that collect, share and sell health information online fall outside of HIPAA’s narrow scope, as the HIPAA Privacy Rule and related requirements only apply to covered entities including healthcare providers, health plans, and clearinghouses, as well as business associates that assist a covered entity in transmitting Protected Health Information (PHI). It may be safe to assume that you’ve already planted your garlic and have just been letting it grow all winter and all spring. Just like me! Waiting and anticipating the big beautiful garlic bulbs that are full of natural goodness during the long garlic growing season. I am totally ready for the harvest time.

I’m excited to share with you the best time to harvest garlic so you won’t ever have to go without garlic in your kitchen. There is nothing compared to fresh minced garlic, sweetened and browned in olive oil, and added to curries, soups, stir-fries, or even rubbed directly to buttered toast. So as early as now, you can bookmark this post and get back to it once you think your garlic is showing signs that it is ready to be harvested!

 

 

When To Harvest Garlic

Harvesting garlic depends on when you plant it, garlic planted in the fall might be ready to harvest in early June or July, but most likely, it will be sometime in August. However, the easiest way to find out if garlic is ready to be harvested is by looking at its leaves.

Harvest when the top of the plant’s leaves start to yellow and fall over  but before they are totally dry. Once the top of its leaves start to turn yellow, just simply start checking the bulbs to see if it is already the proper size.

Loosen the dirt on top of one or two garlic bulbs to get the idea of its size while keeping them on the ground. If they look big enough, you’re ready to make your garlic harvest. However, if the bulbs are still too small, your garlic still needs a bit more time to grow.

Keep in mind that you don’t need to wait too long, because if the garlic leaves are completely brown before you harvest, it may result in an inedible bulb. What a waste!
